1. General Terms

Manufacturer of cosmetic products - Limited Liability Company "H.A.Brieger", registration No. 41503040345, registered office at 30 Mālu Street, Riga, LV-1058, hereinafter referred to as "H.A.Brieger", has established this Internet trading site - online shop www.dzintars.lv, hereinafter referred to as "Amber e-shop", in order to offer customers a convenient and safe opportunity to purchase online cosmetic products manufactured by H.A.Brieger - body, facial, hair and bath cosmetics, oral hygiene products and other cosmetic products, hereinafter referred to as "Cosmetic Products/s" or "Goods/s"



The Dzintars e-shop Terms of Use, hereinafter referred to as the "Terms of Use", shall apply to all persons visiting the Dzintars e-shop or placing an order and making a purchase in the Dzintars e-shop, hereinafter referred to as the "Customer"/or addressed as "you". By using our Dzintars e-shop services, you acknowledge that you are bound by these Terms of Use, hereinafter referred to as the "Terms".



The Terms of Use apply as between H.A. Brieger as the manufacturer and seller of the cosmetic products offered in the Amber e-shop and the Customer. The Terms and Conditions are available on the Amber e-shop web page and an electronic link to the Amber e-shop section "Terms and Conditions" is attached to the order confirmation e-mail sent by the Customer.

H.A.Brieger reserves the right to change these Terms of Use. Please check them each time before using the Dzintars e-shop.

For a Customer who is considered a consumer under the laws of the Republic of Latvia, by placing an order for cosmetic products offered for sale at Dzintars e-shop and making a purchase, such mutual agreement on the purchase of cosmetic products shall constitute a Distance Contract, which shall be subject to the Consumer Rights Protection Act and the Cabinet of Ministers Regulation "On Distance Contract". A Distance Contract for the purchase of a cosmetic product in accordance with these Terms of Use between H.A.Brieger and a Customer who places an order and makes a purchase on www.dzintars.lv shall be deemed to be concluded upon payment for the product, without a separate Distance Contract Document being drawn up.


The sections "Delivery and Returns" and "Privacy Policy" of the Dzintars e-shop are essential and integral parts of these Terms of Use.

Information about H.A.Brieger cosmetic products available for purchase is listed in the Dzintars e-shop and we update this information regularly.


You may purchase H.A.Brieger cosmetic products available for purchase in the Amber e-shop for your own personal use or for a recipient or recipients of your choice.


We deliver cosmetic products purchased in the Dzintars e-shop throughout Latvia and abroad (please note that delivery to all countries is not possible). Detailed information on delivery of products ordered in Dzintars e-shop in Latvia and abroad is provided in the Dzintars e-shop section "DELIVERY AND RETURN OF PRODUCTS".


For each of the cosmetic products available in the Dzintars e-shop we have created a description of the cosmetic product, informing you about the main characteristics of the cosmetic product, ingredients and providing other information about the cosmetic product to make it as easy as possible for you to choose the right cosmetic product for you. We endeavour to be as accurate as possible in the cosmetic product information provided in the Dzintra e-shop, however, in the event of certain minor changes not related to the main characteristics of the cosmetic product, H.A.Brieger may update the product information gradually and therefore cannot guarantee that it is fully up-to-date with the current cosmetic product each time.

The price of the cosmetic product indicated at the time of confirmation of the Customer's order is valid for all purchases in the Dzintars e-shop.


If, after receipt of your order, we find that the price of the cosmetic product indicated in the Dzintars e-shop at the time of purchase differs from the correct price of the cosmetic product in force at that time, we will contact you and ask you to cancel the order for the cosmetic product whose price does not correspond to the price of the cosmetic product in force, but if we are unable to contact you, your order will be cancelled in full and we will refund all payments made for your order.


H.A.Brieger may change the prices and offers of cosmetic products in the Dzintars e-shop without prior notice. All prices for products available in the Amber e-shop are quoted in euros (EUR) and include VAT. Depending on your location, prices in the Amber e-shop may be quoted in the currency of your country.


Shipping costs are not included in the price and are calculated at the time of ordering, depending on the delivery method chosen and the location and delivery location you specify.


The final price of the goods, including taxes and duties as well as delivery costs, is indicated before the conclusion of the Distance Contract. If delivery or postage costs cannot be calculated in advance (for example, for delivery abroad), you will be informed that such charges may apply.

3. Making purchases in the Dzintars e-shop

In order to make purchases in the Dzintars e-shop and conclude a distance contract with H.A.Brieger for the purchase of goods in the Dzintars e-shop, the Customer must have his/her own debit or credit card or bank account.


The purchase and payment of a purchase made by a Customer who lacks legal capacity in the Dzintars e-shop shall be the responsibility of his/her legal representative, such as a parent or guardian, and the purchase shall not be revocable and the purchase price shall not be refundable on this basis.


When placing an order, you have the opportunity to create a wish list of cosmetic products available in the Dzintars e-shop, save your payment information for future purchases and send your feedback on cosmetic products purchased in the Dzintars e-shop.


For the convenience of customers, the cosmetic products available in the Dzintars e-shop are divided into product groups, each of which has its own section in the Dzintars e-shop. In addition, the Customer can use the search option for searching and selecting cosmetic products, which works in all product sections of the Dzintars e-shop.


After selecting and adding cosmetic products to the shopping cart, the Customer has the possibility to view and edit the contents of the shopping cart and the number of cosmetic products added until the order is confirmed.

To complete your order, you must use the "Checkout" menu, select one of the delivery methods we offer and provide your name, delivery address, contact telephone number and e-mail address for contact regarding your order. The delivery price is indicated for each delivery method.


The customer is obliged to provide the exact information required for the execution of the purchase and delivery, otherwise the execution of the order and delivery are not guaranteed.
Before confirming your order, we will ask you to confirm that you have read the H.A.Brieger Privacy Policy and Terms of Use (distance agreement) and agree to their terms.
After confirming your order with the "Confirm order and pay" menu, you must choose one of the payment methods offered by the Dzintars e-shop. By confirming the payment, the Customer undertakes to pay for the cosmetic products ordered.


After payment of the order, we will send the Customer a confirmation e-mail. If you do not receive this confirmation email, please contact our Customer Service.


The ordering of a product shall be deemed to be an offer by the Customer to the Seller to enter into a distance contract for the delivery of the ordered cosmetic product in accordance with these Terms of Use and the order and an agreement by the Customer to purchase the ordered product at the stated price.

Upon receipt of an order in the Dzintars e-shop, we may refuse to fulfil the order if the Customer's debit or credit card is not authorised for payment of the order or the product ordered is unavailable or no longer in production.


The fulfilment of orders for cosmetic products placed on the Dzintars e-shop is subject to product availability. If the product ordered is not available at the time, we will contact the Customer immediately and negotiate the best solution - delivery of the ordered cosmetic product within a reasonable time, delivery of an equivalent product or cancellation of the order with a refund of the purchase price paid by the Customer.

4. Processing of Customer Data

The issues related to the processing of the Client's personal data are set out in the Dzintars e-shop Privacy Policy, which can be found in the Dzintars e-shop section "Privacy Policy" here.


H.A.Brieger ensures the security and use of Customer Personal Data in strict compliance with our Privacy Policy and applicable data protection laws and regulations.


Orders placed by Customers are recorded and stored in the H.A.Brieger Dzintars e-shop database.

Basic principles of customer data processing:

Information on the use of your personal data is available in the section "PRIVACY POLICY".
In order to fulfil an order placed on the Dzintars e-shop on the basis of a distance contract, H.A.Brieger needs to receive and process the personal data provided in the order information for the cosmetic product. In order to conclude a distance contract, you are required to enter your personal data in the order information for the cosmetic product.

A customer who has purchased a cosmetic product from the Dzintars e-shop can make a rating of the product and send a review of the purchased cosmetic product. The rating is automatically added to the rating of the specific cosmetic product. Customer reviews (title and text) can be used and displayed separately on the cosmetic products or in a separate section.

5. Payment of the order

Dzintars e-shop offers payment for cosmetic products ordered by the Customer by selecting one of the following payment methods:

Prepayment by credit card
Card data and payment processing by Luminor Bank AS; we accept the following payment cards.

Prepayment via online banking and payment systems
After confirming the order, Dzintars e-shop redirects the Customer to the offered online banks, where the Customer can log in and pay for the order.


For payment of orders placed in Dzintars e-shop, Luminor Bank AS, Swedbank, Citadele, SEB Banka can be used.


After the payment has been made and the payment result has been confirmed, Dzintars e-shop offers to redirect the Customer back to the online shop.


H.A.Brieger cares about the security of the Customer's payment data and uses data security systems that comply with international security standards, providing encryption of the Customer's payment data.

6. Delivery terms

Dzintars e-shop shall deliver in accordance with the Delivery Terms, which can be found in the section "Delivery and Returns". The Terms of Delivery specify the types of delivery of cosmetic products ordered from the Dzintars e-shop, the delivery prices and delivery terms, as well as the terms for free delivery of goods upon reaching a certain order amount.

The average delivery time in Latvia is 3 to 5 working days after receipt of payment for the order, but H.A.Brieger reserves the right to deliver the goods within 10 (ten) days, as delivery times may vary depending on stock availability and other circumstances (e.g. longer delivery times during sales, before public holidays, postal/courier load, etc.).

Delivery is made to the address indicated by the Customer when confirming the order. Delivery prices are determined in accordance with the tariffs set by the delivery service providers. The Customer shall pay the delivery costs at the same time as payment for the Goods ordered, before receipt of the order confirmation and delivery of the Goods. The delivery price shall be included in the invoice for the order.

7. Return of cosmetic products purchased in the Dzintars e-shop

H.A.Brieger undertakes to deliver to the Customer the products ordered in the Amber e-shop without any defects.

In the event that the Customer has received a damaged, defective or incorrectly assembled (not in accordance with the order) cosmetic product after placing an order in the Amber e-shop, we recommend that you immediately take a picture of the product and send the picture together with a description of the problem to our Customer Service e-mail [email protected] to resolve the issue so that we can clarify the circumstances. H.A.Brieger may contact you for further information.

If the problem is justified, we are responsible for accepting the return of the product in question, unless more than 14 days have elapsed since delivery.

The Customer shall be entitled to exchange incorrectly assembled goods for the goods ordered by the Customer within 14 days from the date of delivery, in which case H.A.Brieger shall bear the delivery costs for the exchange.

If you return a damaged, defective or incorrectly assembled product to us or exchange such a product, we will refund the value of the product and the delivery costs or send a new product instead and bear the costs of returning the product (or alternatively we will arrange for the return of the product at our expense).

8. Consideration of applications

The Customer may submit a complaint regarding non-conformity of a cosmetic product with the terms of a distance contract or any other breach of a distance contract electronically by sending an e-mail to [email protected]. Complaints shall be dealt with within 10 working days from the date of receipt by sending a reply to the e-mail address provided in the complaint.


If we find the complaint to be unfounded and the Customer disagrees, the Customer shall have the right to resolve the dispute in accordance with the procedures set out in the Consumer Rights Protection Act. In this case, the Customer must send us a written application for out-of-court dispute resolution, specifying: his/her name, surname, contact details; the date of submission of the application; the nature of the dispute, the claims and the grounds for them.

9. Right of withdrawal

The Customer may exercise the right of withdrawal provided for in the Consumer Rights Protection Act within 14 days to withdraw from the goods without giving any reason. The withdrawal period expires after 14 days from the date on which the goods have come into the possession of the buyer or of a third party other than the carrier designated by the Customer.


In order to avoid any disputes, the Customer must verify at the time of receipt of the order that the cosmetic products ordered correspond to the order (composition, product names, volume, colour and other relevant parameters).


If the Customer wishes to exercise the right of withdrawal, the following conditions must be taken into account:

In order to exercise the right of withdrawal, the Customer must inform us of the decision to withdraw from the distance contract with an unequivocal notification (e.g. e-mail to the Customer Service e-mail address below), sending a copy of the proof of purchase together with the notification. The customer may use the sample opt-out form attached hereto to provide the above notice.

In order for the withdrawal period to be respected, it is necessary that the Customer has sent his notice of exercising the right of withdrawal to H.A.Brieger before the expiry of the withdrawal period. Please note that the right of refusal cannot be exercised by a person who is not considered a consumer, including a legal entity.

10. Consequences of refusal

In case of termination of the distance contract, the Customer shall be reimbursed the paid purchase price and delivery costs (except for additional costs incurred due to the fact that the Customer had chosen a delivery method other than the standard delivery method offered by Dzintars e-shop, for example express delivery), without undue delay and in any case no later than 14 days from the day we received the Customer's cancellation of the distance contract.

Refunds will be made using the same means of payment that the Customer used to pay for the order for which the right of cancellation has been exercised, unless the Customer has expressly agreed to do so otherwise. In any event, you will not be charged any fee in connection with such refund.

We may withhold the refund until we have received the goods back or the Customer has provided proof that the goods have been returned, whichever is earlier. The goods must be sent back or handed over to us without undue delay and in any case no later than 14 days from the day on which the Customer announced his decision to withdraw from the contract. The deadline will be met if the Customer has sent the goods back to H.A.Brieger before the 14-day deadline.

The customer is obliged to keep both the courier documents for receiving the goods and the postal/courier documents for sending the goods back to H.A.Brieger.

The customer will have to bear the direct costs associated with returning the goods.

The goods can be returned by sending them by post or by courier. You must pack them with such care that they are not damaged during shipping. We recommend using a postal or courier service that provides tracking and insurance.

In all cases when the distance contract is terminated and/or the product is returned to H.A.Brieger, the Customer is obliged to return the gift received together with the product for the purchase of the product or a certain amount of the purchase, except in the case when the Customer has directly refused the gift when placing the order receipt. The gift must be unused and in undamaged original packaging. If the gift is not returned, the Customer must pay for the gift in the amount of its value according to the price of the relevant cosmetic product determined by H.A.Brieger.

11. Cosmetic products

The products offered in the Dzintars e-store are intended for personal use only. The customer does not have the right to use the products purchased in the Dzintars e-store for resale. H.A.Brieger has the right, with or without notice, to refuse, cancel or reduce any Customer order that we have reasonable grounds to believe is intended for resale.

The goods offered in the Dzintars e-store are not food products and are not edible. The design of H.A.Brieger cosmetic products, including smell, color, shape, packaging, is designed in such a way that the cosmetic product cannot be mixed with food and does not endanger the health and safety of consumers.

The goods produced by H.A.Brieger and offered in the Dzintars e-store are safe for human health, they are produced in compliance with good production practices and comply with the norms of the Law of the Republic of Latvia "Goods and Services Safety Law", Regulation (EC) No. 1223/2009 of the European Parliament and of the Council on cosmetic products requirements for cosmetic products and other applicable regulatory enactments in the field of cosmetic products production.

12. Intellectual Property

The content of the Dzintars e-store and the posted information are the intellectual property of H.A.Brieger, which is protected in accordance with the laws of the Republic of Latvia and international laws in the field of intellectual property protection.

Copying or republishing the content of the Dzintars e-store is permitted only for personal use, provided that the Dzintars e-store website www.dzintars.lv is simultaneously indicated as the source of the content and materials.

13. Liability

By registering on the Dzintars e-store website, the Customer assumes responsibility for the confidentiality of his password and user data, as well as for any activity, including the information provided, when placing an order in the Dzintars e-store. If the services offered by the Dzintars e-store are used by a third party using the Customer's registration data, we consider that the information is transferred and used by the Customer. If you have lost your registration data (user name and/or password), you can restore them by following the instructions in the Dzintars e-store entrance section for Registered users, or by calling the Customer phone number +371 20042863.

The customer assumes responsibility for the fact that the data provided to the Dzintars e-store is accurate and correct. If the previously submitted data (contact information) has changed, please make relevant changes to the registered customer's profile.

14. Changes to Terms of Use

H.A.Brieger has the right to renew or change these Terms of Use at any time. Such revised Terms of Use shall enter into force upon their publication on the Dzintars e-store website. You can see the date of changes to the Terms of Use at the end of the Terms of Use. In order for you to be informed about possible changes in the Terms of Use, please look at the Terms of Use section from time to time and make sure that you are familiar with the current version. The Customer must always familiarize himself with the Terms of Use before placing an order for cosmetic products in the Dzintars e-store.
